1. About DOMINEXT and These Terms
DOMINEXT is an online platform focused on education, independent creators, art, workshops, events, community, and a curated shop. We create and publish editorial and educational content, feature independent work, facilitate discovery of workshops and events, host or link to community spaces, and provide an online marketplace where approved independent sellers can offer products to customers.
These Terms of Service (“Terms”) govern your access to and use of dominext.co and all related services, features, accounts, tools, content, communications, and transactions made available by DOMINEXT (collectively, the “Platform”). They apply whether you visit the Platform, create an account, join a community space, read Learn content, book or attend a workshop or event, submit creative work, sell through the shop, or make a purchase.
By using the Platform, you agree to these Terms and to any policies expressly incorporated by reference, including our Privacy Policy, Cookie Policy, Content and Community Guidelines, Shipping and Returns Policy, and Age Verification Disclaimer. If you do not agree, do not use the Platform.
If a specific service, event, workshop, promotion, collaboration, seller arrangement, or transaction is subject to additional terms, those additional terms will apply together with these Terms. If there is a direct conflict, the more specific terms will control for that service or transaction.
These Terms apply to the whole DOMINEXT platform, including Learn, workshops, events, creator and art features, community spaces, and the online shop. Some services are provided directly by DOMINEXT, while others are offered by independent sellers, educators, creators, organisers, or other third parties. The sections below explain the difference.
2. Eligibility, Age and Accounts
- You must be at least 18 years old and meet any higher legal age requirement that applies where you live to use the Platform. By accessing age-restricted areas, registering, submitting content, booking a service, or completing a transaction, you confirm that you meet this requirement.
- We may request reasonable age or identity verification where required for legal, compliance, safety, fraud-prevention, payment, or marketplace purposes. We may restrict or close access if information appears false, incomplete, or inconsistent with applicable requirements.
- If you create an account, you must provide accurate and current information, keep your login credentials secure, and take responsibility for activity carried out through your account. You must notify us promptly if you suspect unauthorised access.
- Customers may be allowed to purchase as guests where available. Sellers and certain other contributors may be required to complete identity, business, tax, or Know Your Customer checks through DOMINEXT or a third-party service provider before receiving access to relevant features.
3. Learn and Editorial Content
DOMINEXT publishes educational, editorial, cultural, and community-oriented content about kink, consent, communication, relationships, safety, art, events, creators, and related topics. This content is intended for general information and education.
Learn content is not medical, legal, psychological, therapeutic, or other professional advice, and it is not a substitute for advice from an appropriately qualified professional. Kink practices can involve physical and emotional risk. You are responsible for deciding what is appropriate for you, communicating clearly with the people involved, and seeking professional guidance where needed.
We may use public sources, research, expert material, interviews, community contributions, or third-party references when preparing content. We aim to publish useful and responsible information, but we do not guarantee that all content is complete, error-free, or suitable for every person or situation.
Content may change as knowledge, standards, laws, or community practices develop. We may update, correct, archive, or remove editorial content at any time.
4. Workshops, Events and Educators
DOMINEXT may feature, promote, organise, co-organise, or provide information about workshops, classes, talks, parties, gatherings, and other events. Some are run directly by DOMINEXT. Others are offered by independent educators, venues, organisers, or partners.
Where a workshop or event is provided by an independent third party, that provider is responsible for the service they offer, including the accuracy of the listing, delivery of the service, participant requirements, safety procedures, cancellations, refunds, and compliance with applicable law. DOMINEXT does not become the provider of that service merely by featuring or linking to it.
Where DOMINEXT itself sells tickets, runs an event, or provides a workshop, the booking page may include additional conditions covering entry, conduct, cancellation, photography, safety, accessibility, refunds, or venue rules. Those conditions form part of your agreement with us for that activity.
Event and workshop content may involve mature themes. Participants must meet the age requirement stated for the specific activity and follow the organiser’s rules, consent standards, and safety instructions.
5. Community Spaces and Communication
DOMINEXT may operate or link to community spaces, including Telegram groups and other third-party communication platforms. These spaces are intended for respectful discussion, connection, learning, and community exchange.
You must follow our Content and Community Guidelines and any rules published for a specific group. Harassment, threats, hate speech, non-consensual sexual content, doxxing, fraud, coercion, impersonation, and unlawful conduct are not permitted.
Community spaces hosted on third-party services are also subject to the terms and privacy practices of those services. DOMINEXT does not control the availability, technical operation, data practices, or independent conduct of third-party platforms.
We may moderate, restrict, mute, remove, or ban participants from DOMINEXT-operated community spaces where we reasonably believe this is necessary to protect participants, enforce rules, comply with law, or maintain the quality of the space.
6. Creators, Art, Features and Collaborations
DOMINEXT may feature artists, makers, educators, organisers, performers, photographers, designers, and other independent creators. A feature, interview, listing, social post, or editorial mention does not create employment, agency, partnership, or exclusivity unless we expressly agree otherwise in writing.
If you submit work, images, text, event information, product information, or other material for consideration, you confirm that you have the rights needed to share it with us. Unless otherwise agreed, you grant DOMINEXT a non-exclusive, worldwide, royalty-free licence to reproduce, adapt for formatting, display, publish, and promote the submitted material in connection with DOMINEXT, the relevant feature, and our own marketing channels.
Paid collaborations, commissioned work, sponsorships, licensing arrangements, and other commercial partnerships may be governed by separate written agreements. Those agreements will take priority for the matters they cover.
7. The DOMINEXT Shop and Marketplace
The DOMINEXT shop is a curated marketplace that gives approved independent sellers a place to present and sell their work. Unless a listing clearly states that DOMINEXT is the seller, the product is offered by the independent seller identified on the product or order page.
For third-party marketplace products, DOMINEXT provides platform technology, curation, listing tools, payment facilitation, communications, and related marketplace services. The independent seller remains responsible for the product, listing accuracy, fulfilment, shipping, legal compliance, and after-sales obligations that apply to the seller under law and these Terms.
Curation, inclusion, promotion, or editorial presentation on DOMINEXT does not amount to a warranty or guarantee by DOMINEXT regarding a product. Any statutory rights you have against a seller remain unaffected.
8. Seller Responsibilities
- Sellers must comply with all seller onboarding requirements, provide accurate identity and business information, and complete any verification requested by DOMINEXT or our payment partners.
- Sellers are responsible for ensuring that their products, listings, packaging, instructions, marketing claims, shipping practices, returns processes, and customer communications comply with applicable laws in the places where they offer or deliver products.
- Listings must be accurate, truthful, and sufficiently clear for a customer to understand what is being offered, including relevant materials, dimensions, variations, care information, safety information, lead times, and any important limitations.
- Sellers must not list illegal goods, explicit sexual content, illegal substances, prohibited weapons, dangerous items, counterfeit goods, or other products that DOMINEXT or a payment, hosting, logistics, or compliance provider does not support. DOMINEXT may maintain additional prohibited or restricted product rules in the Content and Community Guidelines or seller documentation.
- DOMINEXT may review, reject, request changes to, suspend, or remove a listing or seller account where we reasonably believe it creates legal, payment, safety, brand, fraud, or platform-integrity concerns.
9. Customer Responsibilities
- Customers are responsible for reading the full listing before purchasing, checking sizing and product details, reviewing seller-specific shipping or return information, and providing accurate payment and delivery information.
- You are responsible for ensuring that a product can lawfully be purchased, possessed, imported, and used in your jurisdiction. Customs duties, import taxes, brokerage fees, or similar charges may apply depending on the destination and are the customer’s responsibility unless checkout expressly states otherwise.
- Products must be used responsibly and in accordance with any instructions, warnings, or intended-use information supplied by the seller or manufacturer. You are responsible for deciding whether a product is appropriate for your circumstances.
10. Orders, Payments, Fees and Seller Payouts
Orders placed through the marketplace are subject to acceptance and availability. A seller may cancel an order where a product is unavailable, a listing contains a material error, delivery is not possible, fraud is suspected, or the transaction cannot lawfully be completed.
Payments are processed by third-party payment service providers. DOMINEXT does not store full payment card details. Payment providers may apply their own terms, identity checks, risk controls, chargeback procedures, or service limitations.
DOMINEXT currently applies the following marketplace commission structure to seller product revenue during each calendar year:
| Seller Product Revenue per Calendar Year | DOMINEXT Commission | Commission Basis |
|---|---|---|
| EUR 0 – 10,000 | 5% | Product value only |
| EUR 10,001 – 25,000 | 6% | Product value only |
| EUR 25,001 – 50,000 | 7% | Product value only |
| EUR 50,001 – 100,000 | 8% | Product value only |
| EUR 100,001 – 200,000 | 9% | Product value only |
| EUR 200,001 and above | 10% | Product value only |
A third-party payment processing fee of 5% is currently applied to the total transaction amount processed through the payment provider, including product value, shipping, and other amounts included in the payment. DOMINEXT may update seller fees on reasonable notice. Any updated fee terms will apply prospectively as stated in the notice or seller agreement.
Commission tiers are determined by a seller’s cumulative product revenue for the calendar year. When a seller moves into a higher tier, the new rate applies to subsequent transactions unless otherwise stated in the seller agreement.
DOMINEXT may hold seller funds for up to 21 days as a standard reserve period and may hold funds for longer where reasonably necessary to manage refunds, disputes, chargebacks, suspected fraud, compliance obligations, payment-provider requirements, or other transaction risk. Payout timing may also depend on the payment provider and the seller’s verification status.
Sellers are responsible for taxes arising from their sales except where DOMINEXT or a payment provider is legally required to calculate, collect, withhold, report, or remit an amount. Sellers must provide tax information reasonably requested for compliance purposes.
11. Shipping, Returns, Refunds and Consumer Rights
Nothing in these Terms limits any consumer right that cannot lawfully be excluded or restricted. Where mandatory consumer law gives you cancellation, withdrawal, repair, replacement, refund, conformity, warranty, or other rights, those rights take priority over any conflicting marketplace or seller policy.
For products sold by independent sellers, the seller is responsible for fulfilment and for handling returns, refunds, replacements, and defective-product claims in accordance with applicable law and any seller-specific policy shown at the time of purchase.
In addition to mandatory legal rights, a customer may ask the seller for a voluntary refund or return within 21 days of delivery. Approval of a voluntary return is at the seller’s discretion unless the customer has a legal right to the return or refund regardless of seller approval.
Certain products may be excluded from change-of-mind returns where permitted by law, including clearly personalised or made-to-order goods and sealed goods that are not suitable for return for health or hygiene reasons once unsealed. The applicable exception depends on the law governing the transaction and the condition of the item.
Unless applicable law or the seller’s policy requires otherwise, customers are responsible for the direct cost of returning goods. Where an item is faulty, materially misdescribed, unsafe, or otherwise non-conforming, the seller remains responsible for the remedies required by applicable law.
DOMINEXT may assist with transaction communication or payment administration, but this does not remove the legal responsibilities of the seller or the statutory rights of the customer. We may also take action where a seller repeatedly fails to meet legal or marketplace obligations.
12. User Content
Users may submit reviews, comments, listings, images, profile information, messages, event information, or other content. You retain ownership of your content, but you grant DOMINEXT a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, adapt, and distribute it as reasonably necessary to operate, improve, moderate, and promote the Platform and the relevant listing, feature, creator, seller, event, or service.
For seller listings and creator submissions, this licence includes reasonable use of submitted images, product information, excerpts, and related material in DOMINEXT editorial features, newsletters, social media, advertisements, and other promotional channels. Separate commissioned content created by DOMINEXT or on our behalf remains subject to the ownership terms agreed for that production.
You must not upload content that you do not have permission to use, that infringes intellectual property or privacy rights, that is unlawful, deceptive, defamatory, hateful, threatening, or non-consensual, or that otherwise violates our policies.
We may review, edit for formatting, restrict, remove, or refuse to publish user content where reasonably necessary for legal, safety, moderation, quality, payment, or platform-integrity reasons.
13. DOMINEXT Intellectual Property
The DOMINEXT name, logo, visual identity, website design, software, original articles, photography, video, graphics, campaign material, and other content created or commissioned by DOMINEXT are owned by DOMINEXT or its licensors and are protected by applicable intellectual property laws.
Unless we give you written permission, you may not copy, republish, sell, license, scrape, systematically extract, or commercially exploit DOMINEXT-owned content beyond what is allowed by law or necessary for ordinary use of the Platform.
Sellers and creators retain ownership of their own products, designs, brands, listings, and original materials, subject to the licences granted in these Terms or in a separate agreement.
Suspected intellectual-property infringement may be reported to support@dominext.co.
14. Prohibited Conduct and Platform Integrity
You must not misuse the Platform. Prohibited conduct includes:
- fraud, deception, impersonation, chargeback abuse, or manipulation of transactions;
- harassment, threats, coercion, stalking, doxxing, or discriminatory abuse;
- attempting to bypass payment systems, account restrictions, security controls, or technical limits;
- uploading malware, interfering with Platform operation, scraping at unreasonable scale, or attempting unauthorised access;
- using DOMINEXT to arrange or promote unlawful activity, non-consensual activity, or services or products prohibited by our policies or providers;
- misusing another person’s personal information or intellectual property; or
- conduct that materially harms users, sellers, creators, partners, payment providers, or the integrity or reputation of the Platform.
15. Third-Party Services, Links and Providers
The Platform may rely on or link to third-party services, including payment processors, Telegram, ticketing providers, hosting services, identity-verification providers, shipping providers, social platforms, venues, educators, sellers, and other external websites or services.
Third-party services are governed by their own terms and privacy practices. DOMINEXT is not responsible for their independent acts, omissions, content, availability, security, or data practices, except to the extent responsibility cannot lawfully be excluded.
A link, feature, listing, or integration does not necessarily mean that DOMINEXT endorses every statement, practice, or offering of the third party.
16. Affiliate and Referral Programs
DOMINEXT may offer affiliate, ambassador, referral, or creator programs. Participation may require a separate agreement or program rules covering eligibility, tracking, commissions, disclosure obligations, prohibited promotional methods, payment timing, and termination.
Participants are responsible for making legally required advertising or affiliate disclosures and for ensuring that their promotional statements are accurate and not misleading.
17. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the Platform is provided on an “as available” and “as is” basis. We do not guarantee uninterrupted availability, error-free operation, permanent availability of any feature, or the accuracy or completeness of third-party content, listings, or services.
For products sold by independent marketplace sellers, DOMINEXT is not the manufacturer, warehouse, carrier, or direct seller unless the listing expressly says otherwise. To the fullest extent permitted by law, we are not responsible for losses caused solely by a seller’s product quality, fulfilment failure, shipping error, or breach of a seller’s legal obligations.
Kink, workshops, events, community participation, and the use of certain products can involve physical, emotional, interpersonal, or other risks. Nothing on the Platform removes your responsibility to make informed choices, communicate boundaries, use appropriate precautions, and follow professional or product-specific guidance where appropriate.
To the fullest extent permitted by law, DOMINEXT will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of the Platform.
Where liability cannot lawfully be excluded, DOMINEXT’s aggregate liability for claims arising out of the Platform will, to the fullest extent permitted by law, be limited to the greater of: (a) the fees you paid directly to DOMINEXT in the 12 months before the event giving rise to the claim; or (b) USD 100. This cap does not apply where applicable law requires a different remedy or prohibits such a limitation.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including any liability that applicable law requires us to retain, or any mandatory statutory consumer rights.
18. Indemnification
To the extent permitted by law, if you use the Platform for business purposes, sell products, organise or provide services, submit commercial content, or otherwise act in a professional capacity, you agree to indemnify and hold harmless DOMINEXT, its affiliates, officers, employees, and agents from third-party claims, losses, liabilities, and reasonable legal costs arising from your breach of these Terms, your unlawful conduct, your products or services, or your infringement of another person’s rights.
This section does not require a consumer to indemnify DOMINEXT beyond what is permitted under mandatory consumer law.
19. Suspension and Termination
We may suspend, restrict, remove, or terminate access to an account, listing, community space, seller function, submission, or other Platform feature where reasonably necessary to address suspected fraud, legal or payment risk, safety concerns, repeated complaints, policy violations, provider requirements, or other material threats to users or Platform integrity.
Where appropriate, we may ask you to correct an issue before taking permanent action. We may act immediately where the issue is serious, urgent, required by law, or required by a payment, hosting, compliance, or other essential service provider.
Termination does not remove obligations relating to completed or pending transactions, outstanding payments, refunds, disputes, intellectual property, liability, or any other provision that by its nature should continue after termination.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except where mandatory law in your country of residence gives you protections or rights that cannot be waived by contract. Nothing in this section deprives a consumer of any mandatory protection that applies under such law.
Before starting formal proceedings, you and DOMINEXT agree to make a reasonable attempt to resolve the dispute directly by contacting support@dominext.co and providing enough information for the issue to be reviewed.
To the extent permitted by applicable law, disputes that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its applicable consumer or commercial rules, as appropriate. Arbitration may be conducted remotely unless the parties agree otherwise or applicable law requires a different forum.
To the extent permitted by law, claims must be brought on an individual basis and not as part of a class, collective, consolidated, or representative action. This restriction does not apply where the law governing the consumer’s claim does not permit such a waiver.
Nothing in this section prevents either party from seeking urgent injunctive relief where necessary, bringing an eligible claim in small-claims court, or using a court or dispute-resolution process that mandatory law entitles a consumer to use.
21. Changes to the Platform and These Terms
DOMINEXT may add, change, suspend, or discontinue Platform features as the service develops. We may also update these Terms to reflect changes to the Platform, law, payment requirements, safety standards, or our business operations.
If a change materially affects your rights or obligations, we will provide reasonable notice through the Platform, by email, or by another appropriate method. Where required by law, changes will take effect only after the applicable notice period or with any consent required by law.
Your continued use of the Platform after updated Terms take effect means you accept the revised Terms, except where applicable law requires a different form of acceptance.
22. General Provisions
Force Majeure. DOMINEXT is not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, war, civil disturbance, cyberattacks, widespread internet or infrastructure failures, labour disputes, government action, or major failures of third-party services.
Severability. If part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
No Waiver. A failure to enforce a provision immediately does not waive the right to enforce it later.
Assignment. You may not transfer your rights or obligations under these Terms without our written consent. DOMINEXT may transfer these Terms as part of a merger, acquisition, reorganisation, sale of assets, or similar business transaction, subject to applicable law.
Entire Agreement. These Terms, together with the policies and specific terms incorporated by reference, form the agreement between you and DOMINEXT concerning use of the Platform, unless a separate written agreement expressly states otherwise.
